This Privacy Policy describes how SparkLabs LLC collects, uses, discloses, and protects personal information when you visit our website, request a demo, contact us, use Spark (our AI virtual receptionist), call or text any phone number operated by SparkLabs LLC, receive text messages from SparkLabs LLC, or interact with our services in any other way.

Scope: This policy applies to all telephone numbers and messaging programs operated by SparkLabs LLC in connection with Spark, including numbers used for SparkLabs LLC’s own business and numbers provisioned for our business customers (for example, restaurants, salons, contractors, and other local businesses). The same policy applies regardless of which Spark assistant configuration is enabled on a given number.

1. Who we are

SparkLabs LLC provides Spark, an AI-powered virtual receptionist for local businesses. Depending on configuration, Spark may act as a general business information assistant, an appointment-scheduling assistant, an order-taking assistant, or a combination of those capabilities. We serve two groups: business customers (companies that subscribe to Spark through SparkLabs LLC for call handling, bookings, and related tools) and end users (individuals who call, text, or otherwise interact with Spark on behalf of those business customers). Use of Spark is also subject to our Terms and Conditions.

2. Information we collect

Website visitors and prospective customers

When you use our marketing site or request a demo, we may collect:

  • Contact information: email address, phone number, business name, industry, and website URL (optional fields may be left blank).
  • Demo scheduling information: if you book a demo through our scheduling tool, we may receive appointment details you provide (such as name, email, phone, and selected time).
  • Contact form information: name, business name, email address, and message content.
  • Technical information: browser type, device information, IP address, pages viewed, and similar usage data collected through standard web logs and cookies or similar technologies.

Business customers and dashboard users

If you are a SparkLabs LLC business customer or authorized user of our dashboard, we may collect:

  • Account information: name, email address, login credentials (stored in hashed form by our authentication provider), role, and business affiliation.
  • Business profile information: business name, business type, enabled product features, and configuration details needed to operate the service.
  • Usage information: activity within the dashboard and console, such as order management actions and feature settings.

End users (callers and texters)

When you call or text a phone number where Spark answers on behalf of one of our business customers, we may collect:

  • Phone number and, if you provide it, name.
  • Call content and metadata: audio recordings, transcripts, call duration, timestamps, caller ID, and call summaries.
  • General inquiry information: questions you ask about the business (such as hours, location, services, pricing, policies, or availability) and Spark’s responses.
  • Order information: items or menu selections, quantities, order type (pickup, delivery, dine-in, or similar), pricing, payment or pickup preferences, delivery address if provided, special instructions, and related details you provide during a call or text conversation.
  • Appointment information: service requested, preferred or confirmed date and time, staff or resource preferences, pricing, contact details, special instructions, and cancellation or rescheduling requests.
  • Text message content: messages you send to or receive from a SparkLabs LLC-operated number, including keywords, replies, and delivery status metadata.
  • Other information you voluntarily provide during an interaction with Spark.

Business owners, managers, and staff (notification recipients)

When a business customer enables Spark notifications, we may collect and use contact information for authorized recipients (such as owners, managers, or staff), including:

  • Name and mobile phone number used to receive operational text messages or alerts.
  • Email address where email notifications are enabled.
  • Role or notification preferences configured in the SparkLabs LLC dashboard.

Messages sent to business recipients may include end-user information (such as a caller’s or customer’s name, phone number, appointment details, or order details) so the business can fulfill the request.

3. Spark assistant capabilities

Spark may be configured on a phone number in one or more of the following modes. The information collected depends on which capabilities are enabled for that business customer’s number:

  • General business information (FAQ): Spark answers general questions about the business, such as hours, location, services, pricing, policies, and other non-transactional inquiries.
  • Appointment assistant: Spark helps callers schedule, confirm, reschedule, or cancel appointments and may collect service type, date, time, and contact details.
  • Order assistant: Spark helps callers place, modify, or inquire about orders and may collect menu items, quantities, order totals, fulfillment type, and related details.
  • Combined assistant: Spark provides both appointment and order capabilities on the same number, and may collect information relevant to either or both workflows during a single interaction.

Additional assistant features or message types may be added over time. Any new feature that collects personal information will be used only as described in this Privacy Policy or in an updated version posted on this page.

4. How we use information

We use personal information to:

  • Provide, operate, maintain, and improve Spark and the SparkLabs LLC platform.
  • Answer calls and texts, respond to general business questions, process orders, book appointments, capture leads, and deliver summaries on behalf of our business customers through Spark.
  • Respond to demo requests, sales inquiries, and support requests.
  • Create and manage business customer accounts and dashboards.
  • Send transactional and operational text messages to end customers and to authorized business owners, managers, or staff, as described in Section 6.
  • Monitor performance, troubleshoot issues, prevent fraud and abuse, and protect the security of our services.
  • Comply with legal obligations and enforce our agreements.

5. Phone calls and voice interactions

When you place a call to a SparkLabs LLC-operated number, Spark may record and process the conversation to provide the configured assistant service. Voice interactions may be used to capture the information listed in Section 2, route requests to the appropriate workflow (FAQ, appointment, order, or combined), notify the business customer, and improve call handling quality and reliability.

If Spark offers to send you a text message confirmation or follow-up during a call, you may accept or decline. Where you accept, your phone number and relevant transaction details may be used to send the messages described in Section 6.

6. SMS and text messaging

SparkLabs LLC uses SMS and MMS to send transactional and operational messages related to Spark and to requests made through Spark. We do not use SMS to send third-party marketing or unrelated promotional content. Messages may be sent from any SparkLabs LLC-operated phone number associated with a business customer’s Spark configuration.

6.1 Messages to business owners, managers, and staff

Authorized business recipients may receive text messages when an end user interacts with Spark. Examples include, but are not limited to:

  • New appointment notifications: customer name, customer phone number, appointment date, appointment time, service type, and related notes.
  • Appointment changes: rescheduling, cancellation, or confirmation updates involving the same categories of information.
  • New order notifications: customer name, items ordered, order total or cost, fulfillment type, and related order details (for example, “{customer} has placed an order for {menu_item} at a cost of {cost}”).
  • Order status or operational alerts: messages needed for the business to prepare, fulfill, or manage an order or service request.
  • Call summaries or missed-call alerts: caller phone number, summary of the inquiry, and recommended follow-up where enabled.
  • Other business-operational messages reasonably necessary to support the Spark assistant features enabled for that number.

6.2 Messages to end customers (callers and patrons)

End customers may receive text messages related to a request they initiated by phone or text. Examples include, but are not limited to:

  • Appointment confirmations and reminders: business name, appointment date, appointment time, service, and location or instructions where applicable.
  • Order placed: confirmation that an order was received, including items and business name (for example, “Your order of {menu_item} has been placed from {restaurant_name}”).
  • Order ready for pickup: notification that an order is ready (for example, “Your {restaurant_name} order of {order_items} is now ready for pickup”).
  • Order out for delivery: notification that an order is en route (for example, “Your order has been picked up from {restaurant_name} and the driver is on the way”).
  • Order delivered or completed: notification that an order was delivered or completed (for example, “Your {restaurant_name} order of {order_items} has been delivered”).
  • Responses to inquiries: follow-up texts answering a question or providing information requested during a call or text conversation.
  • Other transactional updates about an active appointment, order, or service request for that business (such as delays, modifications, or pickup instructions).

Message content varies by business type and Spark configuration. Placeholders such as {customer}, {menu_item}, {order_items}, {cost}, and {restaurant_name} represent dynamic fields inserted at the time a message is sent. Additional message templates may be used as SparkLabs LLC and our business customers add new industries or workflows.

6.3 Consent

You may opt in to receive text messages from SparkLabs LLC by:

  • Submitting your phone number on our website demo or contact forms where messaging is offered and consent is disclosed.
  • Calling or texting a SparkLabs LLC-operated number and agreeing—verbally during a call with Spark or in writing/by text—when Spark or the business offers a text confirmation or follow-up.
  • Placing an order or booking an appointment through Spark when the business discloses that transactional texts may follow.
  • Being designated as an authorized notification recipient by a business customer during Spark onboarding or dashboard configuration.
  • Texting a designated keyword to a SparkLabs LLC phone number when that opt-in method is made available.
  • Otherwise providing express consent where required by law.

Consent to receive text messages is not a condition of purchase unless clearly disclosed for a specific optional program. Message frequency varies based on your interactions, the business you contacted, and the Spark features in use. You may receive multiple messages related to a single appointment, order, or service request, and recurring messages while a request remains active.

6.4 Opt-out, help, and carrier disclosures

  • Opt out: Reply STOP to any text message sent by SparkLabs LLC to unsubscribe from further SMS messages from that messaging program or sending number, unless a message type is required by law and cannot be opted out of while a transaction is in progress.
  • Help: Reply HELP for assistance, or email llc.sparklabs@gmail.com.
  • Frequency: Message frequency varies. You may receive several messages per appointment, order, or active service request, and occasional operational messages to authorized business recipients when new events occur.
  • Charges: Message and data rates may apply.
  • Carriers: Wireless carriers are not liable for delayed or undelivered messages.

6.5 Mobile information — no sharing for marketing

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing is limited to service providers who assist us in operating our platform (for example, telecommunications, cloud hosting, authentication, and workflow providers) and only as needed to deliver the services described in this policy, subject to contractual confidentiality and security obligations. We do not sell, rent, or share your phone number, SMS consent, or opt-in data with third parties or affiliates for their marketing or promotional purposes.

7. How we share information

We may share personal information in the following circumstances:

  • Service providers: with vendors that help us operate our business, such as cloud database and authentication providers (including Supabase), telecommunications providers (including Twilio), AI voice platform providers (including Vapi), scheduling tools (including Cal.com), email and workflow automation tools, and website hosting providers. These providers process data on our instructions and for our operational purposes only.
  • Business customers: call, order, appointment, and lead information collected on behalf of a business customer is shared with that customer so they can serve you.
  • Legal and safety: when required by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of SparkLabs LLC, our customers, or others.
  • Business transfers: in connection with a merger, acquisition, financing, reorganization, or sale of assets, subject to appropriate confidentiality protections.

We do not sell personal information.

8. Data retention

We retain personal information for as long as needed to provide our services, fulfill the purposes described in this policy, comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods may vary depending on the type of data and the business customer’s configuration.

9. Security

We use reasonable administrative, technical, and organizational measures designed to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

10. Your choices and rights

Depending on where you live, you may have rights to access, correct, delete, or restrict certain processing of your personal information, or to object to certain processing. To make a request, contact us at llc.sparklabs@gmail.com.

You may opt out of marketing emails by using the unsubscribe link in those emails, if provided, or by contacting us directly. SMS opt-out instructions are described in Section 6.

11. Children’s privacy

Our services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe we have collected such information, please contact us so we can delete it.

12. Third-party links and services

Our website and services may link to or integrate with third-party sites and tools (such as scheduling providers). Those third parties have their own privacy policies, and we are not responsible for their practices.

13. Changes to this policy

We may update this Privacy Policy from time to time. The “Last updated” date at the top will reflect the most recent revision. Material changes will be posted on this page. Your continued use of our services after an update constitutes acceptance of the revised policy, to the extent permitted by law.
